RESERVATION CONDITIONS

 

ATTENTION:

You can collect the keys to your accommodation at the Bennecke offices from Monday to Friday from 9:00 a.m. to 6:00 p.m., except holidays. Outside these hours the keys will be collected in a safe and will have an additional charge for the service provided.

1. DEFINITIONS.

 

Bennecke: "Bennecke" means BENNECKE RENT S.L. and it is a company whose corporate purpose, among others, is real estate brokerage and registered in the Mercantile Registry of Alicante Volume 3867, Folio 46, Inscription 1 - Sheet A145451 and CIF number. B54860093.

Leasing: Tourist and / or vacation rental.

Housing: Property leased for tourist and vacation use.

Reservation: Contracting the tourist and vacation rental service hired by telephone, through the computerized system accessed through www.benneckerent.com or directly at the Bennecke office.

Reservation confirmation: Automatic confirmation that occurs when the reservation is made.

Acceptance of reservation: Written confirmation sent by Bennecke within 3 business days of receipt of reservation payment.

Lessee: Natural person / s who make / n the reservation of the tourist or vacation rental and who have the right to enjoy the home during the agreed period.

Price: Final amount to be paid by the Lessee, including rent, additional services and commissions in charge of the same.



2. APPLICATION AND PROHIBITIONS.

 

These terms and conditions (which may be modified from time to time) are applicable only to the tourist and vacation rental services offered contracted by telephone, web service or at the Bennecke office and on other internet portals with which Bennecke has a commercial relationship. .

 

These terms and conditions are generally applicable in that which does not contradict or violate current legislation, in which case said Law shall prevail. If any provision is declared void by judicial resolution, the rest of the provisions, if applicable, will continue to be valid in the extent to which they can remain without the clause declared void.

 

Bennecke is only responsible for the prices or offers published on its website: www.benneckerent.com. It does not do so from errors in price lists or offers on third-party websites where its services are published.

 

It is expressly prohibited, and the Lessee expressly accepts said prohibition, the assignment and the sublease of the rented property.

 

The Lessee expressly waives any right to the home that the legislation may provide for this or any other type of Lease.

 

3. CONFIRMATION AND ACCEPTANCE OF RESERVATIONS AND DOCUMENTATION.

 

To confirm the reservation, the Renter must fill in the reservation form and provide as much information as possible about their travel plan in order to plan the entry and exit of the house and the additional services they want to enjoy.

 

The Lessee expressly indicates for the purposes of making the notifications provided for in this contract and in current legislation, the email address provided in the reservation form. In the event of a change of email address, you must notify Bennecke as soon as possible.

 

From the confirmation of the reservation, Bennecke will block the reserved accommodation until receipt of payment for a period of 3 working days. If payment has not been received after this period, the home will be unlocked and Bennecke will not guarantee that the home will continue to be available. If Bennecke receives the payment after the term has elapsed and the reserved accommodation is no longer available, the Renter may choose to choose another home, provided that Bennecke has one available, or that the money paid is reimbursed. In the case of choosing the first option, if the price between the first and second home is different, the difference will be charged or paid.

 Once the reservation is confirmed, Bennecke will accept it within 3 business days from receipt of payment. Acceptance will be communicated by email to the address indicated by the Renter. If the reservation is not accepted, Bennecke will return the amounts received by the Renter within 7 business days.

 

Acceptance of the reservation gives the right to enjoy the rented home during the contracted period only to those people included in it, prohibiting others from doing so. Once the reservation is accepted, the number of people entitled to enjoy the home may not vary except by express authorization in writing from Bennecke.

 

Once the reservation is confirmed, the Renter will receive an email with the information to perform the mandatory online check-in for all occupants of the house over 14 years of age. The entrances to the houses will not be allowed without having the data of all the travelers.

 

According to Order 1922/2003 of July 3 regarding travelers' records in tourist accommodation, all guests over 14 years of age must present their valid documentation (ID or Passport) and sign the registration part. Said registration will be made at the time of key collection. In case of collecting the keys through the safe, all those over 14 years of age staying must appear within a maximum period of 72 hours in our offices located in C / Cala Dorada, Urb. Rocio del Mar from 9:00 a.m. to 18:00 from Monday to Friday to formalize your registration ".

 

In the event of no-show, Bennecke will pass on to the client the possible administrative, civil or criminal responsibilities that could be caused to the company, as well as bringing the facts to the attention of the Police Commissioner / competent Civil Guard post.

 

Said registration does not remove the obligation to check-in online prior to collecting the keys. Failure to complete the online check-in will have an additional charge of € 10 per traveler for making said registration in person at the office. Registration can only be done during Bennecke office hours.

 

4. PRICES, FEES, TAXES, DEPOSITS AND EXTRAS SERVICES.

 

Prices per night are published on the Bennecke website. The homeowner and Bennecke reserve the right to modify prices in the event of any tax or exchange variation. The modification will be notified by email to the address provided in the form and the Renter may, within 15 days, choose to accept the price variation and pay the difference within that period or choose to cancel the reservation and the reimbursement of the amounts paid. If within the indicated period, Bennecke has not received a reply, he will understand that the Lessee has accepted the price variation and he will have the obligation to pay the difference before the start of the Lease.

 

DEPOSITS

 

It will be mandatory to provide a guarantee on all leases contracted. The tenant will deliver it before arrival at the house and it will be returned, once Bennecke verifies that the tenant has fulfilled all its payment and conservation obligations. All bonds will be withheld or blocked on credit cards. If the entry to the house occurs during working hours, the deposit will be retained in the office, in the case of entry after hours, the tenant will have to provide their credit card details to retain the corresponding deposit. Cash is not accepted for the payment of the bonds.

 

Regardless of the conditions established by the credit card holder's bank, Bennecke will exercise his right to retain the amount of the deposit for a period of 30 days, which will be extended for a further 30 days, if the rental is for a duration higher.

 

Once the rental period is over and the tenant has abandoned the property, Bennecke will carry out an inspection of it, having to find it without damage and in the same state in which it was delivered, the deposit will be returned through the same means of payment , once the 30 days of retention established by the bank have elapsed.

 

The amount of the deposit will be:

 

  • 1 bedroom homes = € 300.00
  • 2 bedroom homes = € 400.00
  • Homes with 3 or more bedrooms = € 500.00

 

When the damage caused to the property by the tenant or third parties under his charge, is greater than the deposit provided, the tenant authorizes to charge them on the credit cards whose data he has provided in order to comply with the obligations arising from this contract. The same will apply with respect to damages, if any, and unpaid supplies, when these exceed the amount of the deposit.

 

EXTRA SERVICES

 

  • Key collection and check-in outside Bennecke office hours (Monday to Friday from 9:00 a.m. to 6:00 p.m., except holidays): € 30 per reservation.
  • Key collection in the Alicante Airport car park: € 40 per reservation.
  • Early entry to the rented house (from 10.00 am): € 30 per reservation.
  • Late check-out of the rented property (until 4:00 p.m.): € 30 per reservation.
  • Extra bed rental: € 10 per night, cot: € 5 per night, baby highchair: € 3 per night.
  • Additional bed linen and towels: € 20 for each additional set.
  • Basic food package: € 50

 

5. SCHEDULES AND DELAYS.

 

The start and end of the Lease will be made without additional charge within Bennecke's office hours (Monday to Friday from 9:00 a.m. to 6:00 p.m., except holidays). Outside these hours the keys will be collected in a safe. Bennecke will not offer the face-to-face reception service for the start of the Lease outside of business hours. Telephone calls will be answered after hours and on weekends from 9 AM to 6 PM on the emergency telephone number: +34 965 714 362. Customer service is not provided outside these hours.

 

Unless otherwise agreed, the Renter must go to the Bennecke offices to carry out all the necessary steps to access the home.

 

The house will be available from 4:00 p.m. on the beginning of the Lease. If the tenant needs to access the house before that time, he must notify Bennecke as soon as possible. In any case, Bennecke must approve it in writing.

 

The tenant must leave the house before 10 am on the end of the Lease. If the tenant needs to leave the house after that time, he must notify Bennecke as soon as possible. In any case, Bennecke must approve it in writing and the Renter will pay a surcharge of € 30.00 for each full hour that exceeds 10.30am on the day. The same charge will be applied to entries to the homes before 4:00 p.m. without the express authorization of Bennecke.

 

In the event that entry is delayed for any reason, you must notify Bennecke as soon as possible so that he knows the new arrival time. Bennecke will not have the obligation to wait for the Renter when the delay has not been communicated to him. A surcharge of € 20 will be applied for each hour of delay if it involves the assistance of an agent outside office hours.

 

6. CHANGES IN RESERVATIONS

 

Any change (before or after the reservation) or exception to these conditions must be agreed in writing between Bennecke and the Renter.

 

Like any other change, the change of the lease date must be agreed between Bennecke and the Lessee. In addition, it has a cost set at € 15 for administration expenses.

 

7. RULES OF CONDUCT.

 

The Lessee is obliged to observe the Laws and regulations of the Community of Owners at all times. In the event that he does not do so, they must leave the house immediately, without prejudice to the compensation that their conduct could give rise to in favor of Bennecke, the owner or third parties.

 

It is not allowed to introduce pets to the house without the express consent of its owner. The introduction of unauthorized animals will give the right to cancel the contract.

 

Smoking is only allowed on the terraces, balconies and exterior areas of the house.

 

8. STATE OF THE PROPERTY AND CHARGES RELATED TO ITS CONSERVATION.

 

The price of the accommodation includes upkeep, maintenance and repairs (except for those that exceed normal and diligent use). Bennecke will attend to all questions that may arise related to the home and its condition during his office hours.

 

When the damage caused to the property by the tenant or third parties under his charge exceed normal and diligent use, the tenant will be responsible for them, authorizing to charge the amount on the credit cards whose data they have provided in order to comply with the obligations that derive from this contract. The same will apply with respect to unpaid supplies.

 

Bennecke is not responsible for the activities carried out by third parties / companies outside the accommodation, eg: common areas or nearby areas.

 

The Lessee has the obligation to report any damage to the home at the time of accessing it. Any damage reported later may be attributed to the Lessee.

 

If when accessing the home the Tenant observes any essential problem in the home, the parties agree that the search for a solution will be governed by the following rules:

 

  1. First, you will study the problem to see if it can be solved within 24 hours.
  2. In the event that it is not possible to solve within the aforementioned period, Bennecke will assign the Tenant another home with similar characteristics if available within a maximum of 24 hours from when it was known that the problem could not be solved.
  3. If there were no available housing, Bennecke would return to the Tenant the amounts paid for the service and compensation for an amount equal to twice the advance made.

 

Incidents related to:

 

  • Basic supplies (water, electricity, gas).
  • Access to housing.
  • Events that compromise the habitability of the home.

 

The rest of incidents will be dealt with during working hours of the Bennecke office, which can be:

 

  • Internet, television, appliances, including air conditioning.
  • Furniture and inventory.
  • Any other matter that does not affect the habitability of the home.

 

Once the Tenant has accessed the home, Bennecke must be notified by the Tenant of any incident that may occur in the home through the online portal help.bennecke.com and incidents reported by other means of communication will not be addressed. When such incident has not occurred due to any malicious or reckless conduct on the part of the Renter, Bennecke undertakes to resolve it as soon as possible, or, where appropriate, to change it for another that is available. The Lessee waives any compensation for breach of contract if he decides to abandon the home without giving Bennecke the option to repair it.

 

In the event of any incident occurring in the home during the term of the lease, Bennecke undertakes to send a technician to carry out the necessary repairs as soon as possible. If the tenant is not in the home when the technician makes the visit, Bennecke will be empowered to facilitate entry by using the key he has to the home. The technician will leave a notification in the home about your visit and the resolution of the reported incident.

 

Bennecke will provide one set of sheets for every 7 days in each dwelling including one set of towels per traveler.

 

Each home will have at the Tenant's disposal the complementary service of beach towels. For each lost or damaged towel a charge of € 15 will be applied.

 

9. PAYMENT CONDITIONS.

 

Reservations made up to 28 days before: The Renter will pay 25% of the price when Bennecke accepts the reservation and the remaining 75% up to 28 days before the start of the lease.

 

Reservations made less than 28 days in advance: The Renter will pay 100% of the price when Bennecke accepts the reservation.

 

There are two means of payment for reservations:

  • Payment by debit / credit card by virtual POS.
  • Payment by bank transfer. When the payment is carried out through this method, the term established in the third clause will begin when the transfer is received (normally within 72 hours from the reservation) or a supporting document confirming the transfer by the Renter. As long as Bennecke has not accepted the reservation, he reserves the right to cancel it. Expenses of the international transfer will be in charge of the Lessee.

 

10. CANCELLATIONS.

 

If the Renter cancels the reservation, Bennecke will have the right to be paid the management expenses that are duly justified.

 

Likewise, except in the demonstrable case of force majeure of the client, the company will also have the right to compensation consisting of:

 

  • 10% of the price when said cancellation is made more than 30 days in advance of the one set for the occupation of the accommodation.
  • 50% when done more than 7 days in advance and up to 30 days.
  • 100% when the cancellation is made 7 or less days in advance.

 

The amount resulting from the application of the previous percentages will be withheld from the advance that, where appropriate, the client would have delivered. The

Justified management expenses if there was a balance for it.

 

When it is Bennecke who does not attend the reservation confirmed by him, he will give the client a choice between:

 

 a) Occupy another accommodation of equal or superior characteristics and category.

 b) To withdraw from the contract, with the payment of the amounts that have been contributed.



11. ADDITIONAL SERVICES.

 

All additional services offered on the Bennecke website must be paid for together with the reservation. The Lessee must send Bennecke sufficiently in advance any necessary and relevant information so that Bennecke can plan the contracted services and check their availability.



12. DATA PROTECTION.

 

In compliance with Organic Law 15/1999, of December 13, on the Protection of Personal Data and REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, the client is informed in a way unequivocal and precise, and expressly authorizes BENNECKE RENT SL to collect and process automatically in a file for which it is responsible for the data contained in this contract.

 

The data collected will become part of a file called CLIENTS AND / OR SUPPLIERS owned by BENNECKE RENT S.L with CIF: B54860093. This file is solely for the purpose of proceeding with the proper management of the function requested from BENNECKE RENT S.L.

 

The person responsible for the file is BENNECKE RENT SL itself, before which the interested person may exercise the rights of access, rectification, deletion, portability, limitation or opposition to the processing of their data, as well as withdrawing the consent given or making claims before the Authority of control. Said actions may be exercised by sending the request by email to [email protected] or by postal mail C / CALA DORADA 1, URB ROCIO DEL MAR 03185 TORREVIEJA, ALICANTE; with the reference "Data Protection", all of which, BENNECKE RENT S.L undertakes:

 

  • To keep the maximum confidentiality about all the information that is provided or to which the client has access in the execution of this contract.
  • To safeguard and prevent access to data and information owned by the client by third parties unrelated to this contract. As well as avoid the alteration, loss, treatment or unauthorized access. Obligation that will subsist indefinitely even after the termination of this contract.
  • To guarantee the corresponding security level
